CANAL GALLERY
- CANOE/KAYAK RENTAL AGREEMENT -
Please read carefully before signing. This is a legally binding rental agreement and a waiver of certain rights.
This is to certify that I have this day rented and received from Canal Gallery/canaltripping for my personal use, the following described property:

I understand that participation in this activity and/or use of this equipment may result in injury or illness including, but not limited to bodily injury, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability.
I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or conduct of the owners, agents, officers or employees of CANAL GALLERY, or by any other person.
I, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify CANAL GALLERY and its owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of the above equipment or my participation in this activity. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of CANAL GALLERY.
I agree to keep safely said equipment and to return it to CANAL GALLERY on demand and in as good condition as when received, and in default thereof, I agree to pay to CANAL GALLERY all losses and damages that may be sustained by reason of any such failure: and I further agree, at my cost and expense, to defend you and save you harmless on account of any and all suits or demands brought or asserted by reason of injuries to any person or property whatsoever caused by the use or operation of said equipment while in my possession, and to pay all judgments, liens or other encumbrances that may be levied against you or the said equipment on account of the use thereof.
It is further understood that the undersigned will be liable for all losses or damage due to theft, fire or any other cause whatsoever, while said equipment is in his/her possession. Customer shall pay the retail replacement cost for each damaged, lost or unreturned piece of equipment.
I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE CANAL GALLERY INC. FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

Wear your PFD!
Our boats are safe when used properly, but will tip if you're careless. We advise you not to go out in high wind, use your intuition and be cautious, and paddle with a buddy. We advise you not to rent our boats if you are not a competent swimmer.
Lock your cell phone and valuables in your car, and use a water-tight camera case. We do supply dry-bags on request. Bring your own PFD and/or paddle if you feel more comfortable with them. Bring sunscreen, a hat, water and snacks. Whatever you forget is sold in Merrickville.
Don't be afraid to cancel and reschedule if the weather is not suitable - we want happy outcomes, and cancellations are always part of this business.
